Mr. Janke said that he would post a position statement to relevant newsgroups and hoped that a frank and open discussion would result. I said that I appreciated his directive to restore my account and that I welcomed a chance to clarify both the facts and our mutual positions concerning this issue. I still deny violating the TOS/AUP in effect at the time of the wrongful termination of my account at or before noon on October 16, 1997. Mr. Janke said that he would address with some specificity the portion of the AUP that he felt that justified their original action. During our frank conversation he said he was surprised to learn that he was the first one from any one of his family of companies to contact me about this issue via any means since the disabling of my account. He was also surprised to learn that there may have been communication from his employees to third parties that may have included false statements about Grady Ward. He said that mistakes had been made internally and that he was addressing internal policies that needed to be clarified for the benefit of everyone. He also said that I stepped over the line with respect to the boundary of free speech. I respectfully disagreed with him and invited his analysis of the TOS/AUP compared to the posting at issue. We both are seeking a just, win-win result. I am reposting to alt.binaries.scientology and alt.binaries.misc the .pdf (Adobe Acrobat format) of the TOS/AUP that was in effect at the time of my termination. I hope to hear some cogent analysis of why or why not Tidepool could justify its decision to terminate my pre-paid account without warning.
