Your letter of January 22, 1963, and enclosures, to the Director
of the Federal Bureau of Investigation have been referred to me for
consideration.
The subject matter of the action involving the Academy of
Scientology is a quantity of "Hubbard E-Meter" devices held on the
premises of the organization, and which investigation by the Food
and Drug Administration revealed were misbranded under the Federal
Food, Drug, and Cosmetic Act. The proceedings are not directed
against the Founding Church of Scientology, nor any individual, and
are not designed to interfere with the constitutionally protected
rights of any person.
The seizure of the devices was made in strict conformity with
approved routine legal procedures, and the Federal Marshals
involved performed their duties with dignity and restraint. The
owners of the devices have the opportunity to contest the action in
a court of law, and at that time may raise all pertinent
objections.
We share your concern for freedom of religious belief, and you
may feel assured that in any action by the Government this interest
will be carefully protected.
